Alternative Dispute Resolution

The Alternative Dispute Resolution Group insists on working with clients in a conference room, rather than a courtroom. Frost Brown Todd has lawyers trained in the two primary forms of Alternative Dispute Resolution (ADR): mediation and arbitration. In mediation, the parties, by agreement or court order, meet with a mediator who assists them to reach a mutually acceptable resolution of their dispute. Usually, mediation is non-binding with the costs paid by the parties. In arbitration, the parties, by agreement or court order, present evidence concerning their dispute to one to three arbitrators who then decide their dispute for them. Usually, arbitration is binding with the costs paid as agreed by the parties or ordered by the arbitrators.

Our experience

A member of the Alternative Dispute Resolution Group can serve as a mediator to facilitate agreement between parties or as the sole arbitrator, or a member of a panel of arbitrators, to decide disputes between parties. When not serving as a mediator or arbitrator, members also serve as counsel to parties in ADR.

Our ADR team has decades of successful litigation experience in administrative, state and federal bodies in various industry and practice areas. Team members have enhanced their considerable courtroom experience with court sponsored training in ADR; with the jurisdictions where we practice; or with academic training in ADR, at Duke, Harvard and the Center for Effective Dispute Resolution in London, England. Our ADR team’s experience and training qualifies them to help clients resolve their dispute at an acceptable cost, promptly and confidentially.
