Patricia K. Burgess
Patricia serves as counsel to the Lexington office of Frost Brown Todd LLC. Prior to joining the Firm, she was a member with the Lexington firm of Sawyer & Glancy PLLC. She concentrates her practice in bankruptcy and reorganization law, work-outs and restructurings, debtor/creditor rights and commercial litigation.
Patricia actively represents banking institutions, business entities and individuals in various capacities, such as secured creditors, debtor in possession lenders, unsecured creditors and purchasers of assets, in a wide variety of bankruptcy cases. Conversely, she represents corporate and individual debtors and debtors in possession, as well as creditors' committees in both large and small Chapter 11 bankruptcy cases. She also represents both creditors and debtors in negotiating out-of-court work-outs and restructurings.
Experience
Patricia represents and has represented secured and unsecured lenders in complex commercial bankruptcies such as: SouthEast Telephone, Lykins Enterprises, Preferred Automotive, Consolidated Energy, Gilbert Homes, Young Earthmoving Company, HealthEssentials Solutions, Inc., Horizon Natural Resources Company, Lodestar Energy, Inc., Cook & Sons Mining, Inc., AJB Investments, B&L Utility Contractors, Inc., B&P Apartments, Coleman Oil, Trey K Mining & Electric, Inc., and Hendricks Communications. She also represents and has represented creditors in both large and small individual Chapter 11 cases, such as Wallace Wilkinson.
Patricia advises Toyota Motor Engineering & Manufacturing North America, Inc. and its North American affiliates in matters relating to troubled automobile parts suppliers including large supplier and automotive bankruptcies such as: Dana Corporation, Delphi Corporation, Johnson Rubber Company, Excello Engineered Systems, Intermet Corporation, Lear Corporation, General Motors and Chrysler.
Patricia has represented multiple individual and corporate debtors both in and out of Chapter 11 bankruptcy, including trucking companies, franchisees and franchisors, real estate investors, restaurant owners, communication companies and automotive suppliers.
Her practice also includes business and banking litigation such as preference litigation, enforcing and defending mechanic’s liens, defending lender liability claims, general contract disputes and collection actions.
