U.S. EPA Releases Proposed SPCC Amendments

On December 12, 2005 , U.S. EPA proposed to amend the Spill Prevention, Control, and Countermeasure (SPCC) Plan requirements for certain facilities and extend the dates by which all facilities must prepare and implement SPCC Plans. A brief summary of the proposed amendments can be found at www.epa.gov/oilspill/nprm.htm. 

Under the proposed rule, all regulated facilities now have until October 31, 2007 to prepare or amend, and implement their SPCC Plans.   Under the current rule, SPCC Plans must be prepared or amended by February 16, 2006 and implemented by August 16, 2006 .  According to U.S.   EPA, the proposed extension is intended to allow facilities to take advantage of the proposed amendments and provide regulated facilities with an opportunity to understand material presented in U.S. EPA’s SPCC Guidance for Regional Inspectors document, which is available at www.epa.gov/oilspill. The document is intended to provide owners and operators with information on how U.S. EPA intends for the SPCC rule to be implemented.
