Medical Staff Disputes

We routinely represent hospitals and their medical staffs in numerous disciplinary actions involving physicians alleged to have provided deficient patient care or whose conduct in dealing with patients, their families, other medical staff members or the hospital’s administrative staff has required disciplinary action. We’ve handled such disputes at every level, including initial investigations, medical executive committee meetings, internal administrative proceedings, governing board review, and, where it cannot be avoided, litigation in the Federal and State courts. We are familiar with National Practitioner Data Bank reporting requirements and with structuring settlements to minimize costs and comply with all Federal and State reporting requirements. We assist clients in complying with Health Care Quality Improvement Act (HCQIA) standards to assure hospitals maintain the immunities provided under that important legislation We also assist hospitals in improving their Medical Staff Bylaws to assure HCQIA compliance while minimizing the costs of dealing with physicians whose performance requires determined action. We advise our clients on compliance with standards of The Joint Commission and with the Medicare Conditions of Participation.
