Plan Compliance Challenges

Every year, employers face many new requirements for their benefit plans. FBT's attorneys meet weekly to review new laws, regulations and cases, and to analyze how they impact our clients’ employee plans and their businesses. Currently, the most significant compliance challenges include:

It can also be a challenge when a benefit plan is under audit by the government. We represent employers when their plans are audited by the Internal Revenue Service (IRS), the Department of Labor (DOL) or the Pension Benefit Guarantee Corporation (PBGC). 

We often assist employers with benefit plan matters when a merger or acquisition occurs. We perform due diligence on benefit plans to identify potential liabilities, draft plan-related provisions of purchase agreements, and help employers determine how best to handle benefit plans in the transaction.
